“Tell me in writing whether your agency is the custodian, or name the public body that is.”
He responds to the Oregon State Board of Nursing’s November 2, 2026, letter and writes, “Tell me in writing whether your agency is the custodian, or name the public body that is.”
Public Records Officer,
On November 2, 2026, you wrote: “We are uncertain whether we possess or are the custodian of responsive records.”1
My request is for your agency’s own records.2 The Attorney General’s manual for public bodies says that “any public body that possesses or owns a public record for purposes related to one or more of its particular functions is a custodian of that record.”3
Tell me in writing whether your agency is the custodian, or name the public body that is. Follow the statute [ORS 192.324(2), ORS 192.329(2)(d)].
Thank you for your contribution to the record.
