RE: Public Records Request
Dear Mr. White,

The Board is in receipt of your Public Records request dated November 2, 2026, requesting the following documents and a fee waiver:

1. All communications sent to or received from either of these Oregon State Police accounts, through any channel the agency uses: emails, Microsoft Teams chat and channel messages, text messages, and voicemail, including attachments and replies.
2. All communications sent to or received from Captain Kyle Kennedy and Media Relations, through any channel the agency uses: emails, Microsoft Teams chat and channel messages, text messages, and voicemail, including attachments and replies.
3. All communications sent to or received from either of these OSP Public Information Officer, through any channel the agency uses: emails, Microsoft Teams chat and channel messages, text messages, and voicemail, including attachments and replies.
4. All communications sent or received including these terms: threat assessment, situational awareness, welfare check, knock and talk, and grievance.
5. Date range: January 1, 2023, to the date of search.
I am writing to you within five days after receipt of the requests in accordance with ORS 192.324(2). Please be aware that the Oregon Board of Tax Practitioners is a small board comprising only two employees, regulating about 4,000 licensees (LTC's and LTP's) and registrants (REA's and RTA's)working on Personal Oregon Income Tax Returns. This State Agency has no jurisdiction to communicate with the police about members of the public unless a member of the public were to commit an act that interferes with the agency, it's licensure or constitutes a safety threat. As the director of this agency, I would have been directly involved if any such incident occurred and non-have since I have become the director for the Board of Tax Practitioners since September of 2022.

The only other item this agency deals with on the criminal side is if an applicant, licensee, or registrant has a criminal record and wants to become registered in the State. In those rare cases, we do not work with police directly, instead the burden is on the applicant, licensee or registrant to supply written records of their criminal case to this agency.

I have conducted a thorough search of our internal database, files and e-mails and found that there were no records responsive to your request. While I did run an internal search of our drives we do work with DAS-IT for record retention. Please note that I have not requested that IT run a search on their drives since I believe there are no records that would be responsive being that this board does not communicate with the police as mentioned and my knowledge that this has been the case since becoming the director. The other reason we are not requesting these from the IT department is the fee the Board would need to pay for these records. The Board believes that no such records exist due to the above information and because there were no results were found during the internal search. I hope that the internal search and explanation of this agency will be sufficient to complete and close your records request.

Please advise if you consider the above information and explanation sufficient in response to your records request as to not require us to spend any further resources conducting a more formal search through our IT partner.

I do understand if that is not the case and will proceed accordingly if necessary but either way I do hope that the above information and explanation helps to explain the Board of Tax Practitioners and what this agency does and why we would not have any of the aforementioned files.

Best,
Laura Ayars
