RE: Public Records Request

Public Records Officer,

On October 30, 2026, you sent an invoice for $1,747.12.1 It does not name the tasks, the hours, or the rates. It says nothing about the fee waiver I asked for in my request of October 27, 2026.2

The statute says the custodian decides the waiver. You did not decide it. The Attorney General’s manual for public bodies says that “public bodies should promptly consider requests for fee waiver.”3 The Attorney General’s manual lists what a public body weighs: “the requester’s identity, the purpose for which the requester intends to use the information, the character of the information, whether the requested information is already in the public domain, and whether the requester can demonstrate the ability to disseminate the information to the public.”4 My request addresses each of them, in that order.2

Decide my fee waiver request in writing. Follow the statute [ORS 192.324(5)].

Thank you for your public service.

Respectfully,
Robert Samuel White
