RE: Request for Facilitated Dispute Resolution: Office of the Governor (request of September 5, 2026)
Hi Mr. White, Because of the way the public records law is written, the Oregon Attorney General does not have the authority to adjudicate appeals related to actions taken by an elected state official, including the governor. Those matters may only be appealed to the circuit court. Our office also does not have the authority to compel the governor's office to take action. We can, however, provide guidance and advice on the application of the public records law to individual requests. I can take a look at the matter and share my thoughts with you on them. If the situation calls for it, I can share them with the governor's office as well. To begin, please provide me with a copy of your request, including wherever you made your public interest fee waiver argument, and the response from the governor's office denying the request. Thanks, Todd Todd Albert Public Records Advocate Office of the Public Records Advocate www.oregon.gov/pra
