Board of Accountancy Response RE: Public Records Request
Dear Mr. White, In accordance with ORS 192.329(2), this e-mail is intended as an initial response to your public records request (PRR) from Tuesday, October 27, 2026, with respect to records in the State of Oregon Board of Accountancy's possession related to Captain Kyle Kennedy, Government and Media Relations ([email]) or OSP Public Information Officer ([email]) that contain any of the terms "threat assessment, situational awareness, welfare check, knock and talk and grievance," dating from January 1, 2023 to the date of the search. The Board of Accountancy is a very small agency of seven staff, regulating about 8,000 Certified Public Accountants (CPAs) and about 800 public accounting firms. As such, this state agency has no jurisdiction to communicate with Oregon State Police about members of the public unless a member of the public were to commit an act that interferes with agency business and/or constitute a safety threat of some kind. As an agency head, I would 100% be directly involved in or at minimum aware of any such incidents, and none have occurred since I became Director of this agency in May 2022. Beyond that, the only thing this agency touches criminal side is if a CPA licensee, or applicant for CPA licensure or applicant to sit for the CPA exam, has a criminal record. In those rare cases, we do not work with police directly, instead the burden is on the applicant or licensee to supply written records of their criminal case to this agency directly. That is why I believe that there is zero chance this agency could have any records even remotely responsive to your request. I also hope, even though we do not know each other, that you would appreciate the effort of my explanation as to why that is the case, as opposed a brief response of no responsive records exist. That said, I want to be fully transparent that I did not conduct a formal search that would require the resources of our IT partner (my agency is too small to have its own IT department). Please advise if you would consider my explanation and assurances above a sufficient response to your request that would not require us to spend the resources on conducting a formal search through our IT partner. I understand if that is not the case and will proceed accordingly if that is your wish. Either way I hope you appreciate the explanation and context.
